Terms of Use

Circuit Energy Pty Ltd (ACN 684 826 686, ABN 35 684 826 686) of Suite 14, 1000 Waterworks Road, The Gap QLD 4061 (Circuit Energy, we, us).

1. About these terms

1.1 These terms apply to everyone who uses circuitenergy.org (the Site), including the public Australian Energy Infrastructure Map. By using the Site, or by clicking “I understand” on the public map, you agree to them.

1.2 Clauses 5 to 9 and 14 (the Membership Terms) also apply to anyone who buys a paid plan. A member accepts these terms by ticking the box at checkout, for itself and for the organisation it names (the Member).

1.3 If a Member has also signed an Enterprise Data Licence Agreement with us, that agreement prevails over these terms for the data it covers.

2. Definitions

2.1 In these terms:

Authorised User means an individual employee or contractor of the Member who is given a login under clause 5.3;

Content means the Map, the members’ brief, reports, images, data and any other material on or from the Site, including any copy, image or extract of them;

Map means the Australian Energy Infrastructure Map, in its public edition and its members’ edition;

Plan means a paid plan bought through the Site, including the Professional, Corporate and Enterprise annual plans, the monthly Map Pass, and report subscriptions; and

Member Content means Content available only to Members.

3. General information only

3.1 All Content is general information only. It is not financial, investment, legal, engineering, planning, environmental, grid-connection or other professional advice. It is not a recommendation to make any investment, or to acquire, develop, connect, finance or take any other action in relation to any site, project or asset.

3.2 Content is compiled from third-party public sources that we have not independently verified, and is shown as at the date stated on it. We do not warrant that Content is accurate, complete, current or fit for any purpose.

3.3 The Important notice and layer notes published with these terms on the Site, as updated from time to time, form part of these terms. They cover in particular network headroom and constraint information, the measure-distance and site-assessment tools, named organisations and questions for management.

3.4 You are responsible for making your own enquiries and getting your own professional advice before acting on any Content.

4. No duty of care and no reliance

4.1 We do not owe a duty of care in relation to Content to any person other than as expressly set out in these terms or a signed agreement with us.

4.2 Content must not be relied on by any person who receives it, directly or indirectly, from a Member or anyone else.

4.3 A Member is responsible for every person to whom it gives Content or any extract of it, must tell each of them that the Content is general information only and subject to these terms, and indemnifies us against any claim by such a person arising from that Content, except to the extent the claim is caused by our fraud or wilful misconduct.

5. Membership

5.1 Plans. The Plans, their features and fees are described on the Site at the time of purchase. Annual plans run for 12 months; the Map Pass and monthly report subscriptions run for one month.

5.2 Renewal. Plans renew automatically for the same period at the then-current fee, unless cancelled before the renewal date. We will email a reminder at least 14 days before an annual plan renews.

5.3 Authorised Users. A Member may give logins to up to the number of Authorised Users stated for its Plan on the Site at the time of purchase, unless we agree otherwise in writing. Logins are personal and must not be shared. The Member is responsible for its Authorised Users’ compliance with these terms.

5.4 Changes to features. We may add to, change or remove layers, tools or features to improve the Map or reflect changes in source data, provided the substance of the Plan is maintained.

6. Fees and payment

6.1 Fees are in Australian dollars and exclude GST, which is payable in addition. Fees are charged in advance through our payment provider (currently Stripe) or by tax invoice where we agree.

6.2 We do not store full card details; payments are processed by our payment provider under its own terms.

6.3 We may suspend access to Member Content while any fee is overdue.

6.4 Fee changes. We may change the fee for a Plan by giving at least 30 days’ notice by email before the change takes effect. A Member who does not accept the change may cancel before it takes effect and receive a pro-rata refund of any prepaid fees for the unused period.

6.5 Cancellation. A Member may cancel at any time through its account or by email. Cancellation takes effect at the end of the current Plan period. Fees already paid are not refundable, except as stated in clauses 6.4 and 15.2 or required by law.

7. Licence

7.1 We grant each Member a non-exclusive, non-transferable licence, for the term of its Plan, for its Authorised Users to view and use Member Content for the Member’s internal business purposes.

7.2 Under that licence the Member may:

(a) view and use the members’ map, members’ brief and PDF reports;

(b) save PNG images exported from the map and use them in its internal documents, with the watermark intact; and

(c) share Member Content, including PNG exports, in confidence with its board, audit and risk committee, equity owners, financiers, auditors and professional advisers, for the Member’s own business, subject to clause 4.3.

7.3 The licence ends only when the Plan expires or is cancelled, or if we terminate it under clause 14. After it ends, the Member may keep copies of Member Content already included in its board papers or records, for record purposes only, on the same confidential basis.

7.4 Anyone may view the public map and share links to it. Any other use of the public map, including copying, screenshots or images of it in any document, presentation, website or product, needs our prior written permission. Where we give permission, the image must carry the attribution “Source: Circuit Energy, Australian Energy Infrastructure Map, [date]”.

8. What you must not do

8.1 You must not, and must not let anyone else:

(a) publish, resell, sub-license or distribute Member Content, or share it outside the Member’s organisation, except as clause 7.2 allows;

(b) scrape, crawl or extract data from the Site, the Map, its page code, its embed or data addresses, or the Content, by any automated or manual means;

(c) use Content to build, train, test or improve any database, map, product, service or artificial-intelligence or machine-learning model, or anything that competes with the Map;

(d) reverse-engineer the Map or attempt to reconstruct its underlying data or methods;

(e) get around any login, access control or plan restriction, or share logins; or

(f) remove or obscure any copyright notice, watermark, licence notice or disclaimer.

9. Intellectual property

9.1 We own the copyright and other intellectual property in the Site and Content, including the compilation, classification, layers and methods, other than third-party material.

9.2 “Circuit Energy” and the Circuit Energy logo are registered trade marks of Circuit Energy Pty Ltd (IP Australia 2528371). You may use our name only to identify Content as coming from us.

9.3 Content includes Geoscience Australia data licensed under CC BY 4.0 and AEMO data used under AEMO’s copyright permissions. Nothing in these terms limits any right you have under those licences in source data you obtain directly from those bodies.

10. Updates, corrections and withdrawal

10.1 We update the Map periodically, usually monthly. Each edition shows its “as at” date and supersedes earlier editions.

10.2 We may correct, update, restate, reissue or withdraw any Content, including Content already delivered, at any time and without liability. We are not obliged to update Content or to tell you of a correction, but we will usually note material corrections in the next members’ brief.

11. Named organisations and corrections

11.1 Organisations and projects are named from public sources as at the date stated, for identification only. Naming does not imply endorsement or affiliation, and is not a statement about the conduct, performance or financial position of any person.

11.2 Anyone who believes Content about their organisation or project is wrong may contact us at admin@circuitenergy.org. We will review the request and, where we agree, correct or remove the information in the next edition or sooner.

12. Investment decisions

12.1 Nothing on the Site is an offer, invitation or recommendation to invest in, acquire or dispose of any asset, project, business or other investment. You must make your own independent assessment and get your own professional advice before making any such decision.

13. Liability

13.1 Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, that cannot be excluded under the Australian Consumer Law or other law. Where our liability for failure to comply with such a guarantee can be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

13.2 Subject to clause 13.1 and to the maximum extent permitted by law:

(a) all terms, conditions and warranties implied by law, custom or statute are excluded;

(b) we are not liable to any person for any indirect, consequential, special or incidental loss, or any loss of profit, revenue, savings, goodwill, opportunity or data, however caused (including by negligence), arising from or in connection with the Site or any Content;

(c) we are not liable to any person who uses only the public Site or public map, for any loss however caused (including by negligence); and

(d) our total liability to a Member under or in connection with these terms, however caused (including by negligence), is limited to the fees the Member paid us in the 12 months before the event giving rise to the claim.

13.3 Our directors, employees and agents have the benefit of this clause 13.

14. Suspension and termination

14.1 We may suspend or end a Member’s access by notice if the Member or an Authorised User materially breaches clause 7 or 8, or does not pay an overdue fee within 14 days of a reminder. Where a breach can be remedied, we will first give 14 days’ notice to remedy it.

14.2 If we end a Plan under clause 14.1, fees already paid are not refundable. If we stop offering a Plan for any other reason, we will refund prepaid fees for the unused period.

14.3 Clauses 4, 8, 9, 13 and this clause 14 survive the end of a Plan.

15. Changes to these terms

15.1 We may change these terms by posting a new version on the Site. Changes apply to public users from the date posted.

15.2 For Members, we will give at least 30 days’ notice by email of any change that is materially adverse to them. A Member who does not accept the change may cancel before it takes effect and receive a pro-rata refund of prepaid fees for the unused period.

16. Privacy

16.1 We handle personal information as described in our Privacy Policy at circuitenergy.org/privacy.

17. General

17.1 These terms are governed by the laws of Queensland, and the parties submit to the non-exclusive jurisdiction of its courts. If any part of these terms is unenforceable, it is severed and the rest continues. A failure to enforce a right is not a waiver. Notices may be given by email to the address in the Member’s account or, for us, to admin@circuitenergy.org.

Important notice: Australian Energy Infrastructure Map

Important notice. The Australian Energy Infrastructure Map, the members’ edition, the members’ brief and any report, image, data or extract taken from them (together, the Map) are provided by Circuit Energy Pty Ltd as general information only, under our Terms of Use at circuitenergy.org/terms.

Not advice. The Map is not financial, investment, legal, engineering, planning, environmental, grid-connection or other professional advice. It is not a recommendation to make any investment, or to acquire, develop, connect, finance or take any other action in relation to any site, project or asset. It must not be relied on in place of your own enquiries and professional advice.

Sources and accuracy. The Map is compiled from third-party public sources, including Geoscience Australia and AEMO, that Circuit Energy has not independently verified. It is shown as at the date stated on each edition. Circuit Energy makes no representation or warranty, express or implied, that the Map is accurate, complete, current or fit for any purpose. Locations, routes, capacities, ownership, timing and project status are approximate or indicative and may change; projects may not proceed.

Network information. Network headroom, binding-constraint and congestion information is derived by Circuit Energy from AEMO public data using its own method, and constraint locations are inferred and approximate. It describes past market outcomes only. It is not an assessment of connection capacity, network access, curtailment or future network conditions.

Tools. Measured distances are straight-line distances between plotted points, not route, easement or cable lengths. The site-assessment and nearest-infrastructure tools list plotted features by distance only; they are not a site-suitability, connection or due-diligence assessment.

Named organisations. Owners, proponents and government contract holders are named from public sources as at the date stated, for identification only. Their inclusion does not imply endorsement or affiliation, and is not a statement about the conduct, performance or financial position of any person. If you believe information about your organisation or project is wrong, please contact admin@circuitenergy.org.

Questions for management. Questions in the members’ brief are prompts for the reader’s own enquiry, not findings, conclusions or recommendations. Changes. Circuit Energy may correct, update, reissue or withdraw any part of the Map at any time, without notice and without liability. Earlier editions are superseded.

No duty of care; no reliance. Circuit Energy does not owe a duty of care to, and the Map must not be relied on by, any person, including any person who receives the Map or an image or extract of it from a member or anyone else. To the maximum extent permitted by law, Circuit Energy and its directors, employees and agents exclude all liability (including for negligence) for any loss or damage arising from any use of or reliance on the Map. Nothing in this notice excludes any right that cannot be excluded under the Australian Consumer Law.

Layer notes

Power stations, lines, substations. Geoscience Australia public data; fuel class assigned by Circuit Energy.

Projects and pipeline. Status, capacity and timing from public sources as at the edition date. May be out of date; projects may not proceed.

Ownership and contract holders. Public sources as at the edition date; for identification only.

Gas infrastructure. Facility locations indicative; pipelines 50 km and longer, generalised to about 3 km.

Binding constraints. Bound = non-zero marginal value in the dispatch run (intervention runs excluded). Locations inferred by Circuit Energy and approximate. A marginal value is not a price impact. Past outcomes only.

Network headroom. Indicative only, from AEMO public data. Not connection capacity or a connection assessment.

Data centres, fibre, subsea cables. Public sources; geometry schematic or indicative.

Measure distance and site assessment. Straight-line distances between plotted points (not route or cable lengths); the site tool lists features by distance only and is not a site-suitability or due-diligence assessment.
